TERMS AND CONDITIONS OF ACCESS, USE AND CONTRACT THROUGH THE WEBSITE http://www.corkbrick.com

 

This document regulates the general terms and conditions of access, use and contract through the website of CORKBRICK EUROPE – ARQUITECTURA DE INTERIORES E EXTERIORES, LDA., with registered office at DNA Cascais - Rua Cruz da Popa, 2645-449 Alcabideche, Portugal, Corporate Tax Number 513223371,registered in the Commercial Registry under the number 513.223.371 registered under the number 513223371 (hereinafter, “CORKBRICK” and “Website”).

    I – GENERAL ASPECTS

    The access and the use of the Website, as well as the purchase of any product through the Website, automatically gives the User and Customer capacity and implies full and unreserved acceptance of all the provisions included in the Terms and Conditions, in the version in force whenever you access the Website.

    If you do not fully agree with any of the conditions set forth, you should not access/use or purchase through the Website.

    The User doesn't need to register in order to use the Website. However, some of the features of the Website could depend on registration.

    PRODUCTS CATALOGUE

    All the Products commercialized through the Website are in compliance with the Portuguese and European Union legislation.

    You'll find the products sold by CORKBRICK through the Website. The product essential information shown on the Website only intends to provide a short, informative summary for the visitor’s convenience. The price information excludes taxes and charges of shipment expenses, according to the destination of the product.

    CORKBRICK reserves the right to change, delete or move any information on the Website, at any time, without prior notice.

    CORKBRICK reserves the right to modify at any time the information and commercial offer presented on products, prices, promotions, commercial conditions and services.

    CORKBRICK makes every effort to ensure that the information and data on the Website are accurate and up-to-date when they are added to the Website. However, CORKBRICK makes no commitment to update or correct this information. CORKBRICK makes no express or implicit guarantee as to the accuracy or completeness of any information (including information on goods and services) included in the Website.

    Users expressly accept and recognize that:

    1. The photos shown on the Website are for illustration purposes only; as such, CORKBRICK recommends that the User and the Costumer consult the detailed description of the product in order to obtain complete information about its characteristics.
    2. CORKBRICK will make every reasonable effort to include accurate up-to-date information on the products on the Website, but this is not guaranteed;
    3. CORKBRICK does not guarantee the items shown on the Website are in stock, nor does it accept responsibility for discontinued items.
    4. In the event that the information presented does not correspond to the actual characteristics of the product, the User assists the right to terminate the purchase and sale agreement in the applicable legal terms.
    5. CORKBRICK Brocks can crumble slightly with its continue use. This crumbling shall not be considered a defect or a damage since it does not affect its use and its functionality.
      Due to their natural characteristics, all BROCKS should be handled with care and they CAN NOT suffer sudden falls or heavy/sudden impact at the risk of being damaged. 
      The client should also avoid an intensive solar exposure because BROCKS can change their natural color.
      Nevertheless, as we nurture a lifelong relationship with our Fans, we are pleased to offer you an unlimited exchange warranty, under the conditions mentioned here ( 3) EXCHANGE) .

    SHOPPING LIST

    CORKBRICK makes available, in its Website, the possibility of the User to add various products sold by CORKBRICK to a shopping list.

    Once the User has selected the items he/she wants, he/she can print out his/her Shopping List, save it in his/her computer in PDF format or send it by email.

    "CORKBRICK PLAY" SOFTWARE

    CORKBRICK soon will make available in its Website, the "CORKBRICK PLAY", a computer software that allows the User to try different combinations with CORKBRICK BROCKS, designing a room, furnishing it, changing the furniture layout and choosing a variety of styles until he/she is happy with the result.

    The User can view and save the options he/she think are most satisfactory, including the list of CORKBRICK BROCKS used..

    The use of this computer software is dependent on reading and accepting the licence agreement concerning to it.

    IV – REGISTERED USER PROFILE

    REGISTRATION

    In order to access a wider range of features, the User can register his/her profile on the Website.

    For this purpose, the User must fill in a form in which, besides the optional elements, he/she must provide the data:

    1. First and Last name;
    2. Email address;
    3. Password.

    All the information the User provides should be true. The User should update the information he/she provides to CORKBRICK whenever any changes occur. The User is exclusively responsible for any false or inaccurate statements he/she makes and for any damage caused to CORKBRICK or third parties through the information he/she provides.

    CORKBRICK will not be responsible for any damages caused by misuse or negligence use of the password defined by the User for accessing to his/her profile. The User should assure the confidentiality of his/her password.

    ADDITIONAL FEATURES

    The Registered User will have access to a personal area, using the details he/she has specified on registration.

    PLANNERS AND SHOPPING LIST

    The Registered User can save his/her plans and shopping lists on the CORKBRICK server. This will allow him/her to consult them later.

    VI – INTELLECTUAL AND INDUSTRIAL PROPERTY

    Unless otherwise provided for, all the Website’s materials, including the design, texts, graphics, photos and content displayed, are intellectual property held, controlled or licensed by CORKBRICK worldwide. Any alteration, reproduction, duplication, copying, distribution, sale, resale and other forms of use, for business or other purposes, is prohibited. Any use of data mining, robots, or similar data gathering and extraction tools is prohibited.

    You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of CORKBRICK. You may not use any meta tags or any other "hidden text" utilizing CORKBRICK’s name or trademarks.

    The social denominations, trademarks, as well as any distinctive signs reproduced on the Website are protected in accordance with the legal provisions applicable to industrial property. Reproduction or representation of all or part of such distinctive signs is strictly prohibited and must be the subject of prior written consent of the respective holders.

    All rights not expressly granted to you by law or in these Terms and Conditions of Access, Use and Contract are reserved and retained by CORKBRICK or by third parties. The stipulations of this document should not be construed as granting any licence or right to any intellectual or industrial property held by CORKBRICK or by third parties.

    VII – LIMITATION OF LIABILITY

    The User is responsible for the content of the information he/she submits or uploads to the Website.

    The User acknowledges that the use of the Website may not be 100% secure, and that there is a possibility that the information sent/received are intercepted by unauthorised parties. CORKBRICK is not responsible for security breaches of the communications and accepts no responsibility for misuse of your information by third parties.

    The User acknowledges that the access and use of the Website may be interrupted and that the Website information may contain bugs, errors, technical failures, problems or other limitations. CORKBRICK is not liable for damages resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, navigation or service to Users.

    VIII – OBLIGATIONS OF USERS AND CUSTOMERS

    The User and the Customer undertake to comply with and comply with these Terms and Conditions of Access, Use and Contract, namely:

    1. To refrain from introducing, storing or disseminating through the Website defamatory, obscene, insulting, xenophobic and / or any other content that violates the general principles of law and public order;
    2. To save and not divulge your password to enter the Website in order to prevent third parties from accessing your account at the Website.
    3. Not to use false identities;
    4. To provide the personal data and the correct addresses so that CORKBRICK can process the orders properly.

    Users are therefore expressly prohibited from transmitting messages or information that are abusive, misleading, defamatory, obscene or in any way violating the right to privacy or the intellectual or industrial property of third parties, as well as to make available any information that may be harmful to third parties or to the Website owner.

    CORKBRICK reserves the right to delete the account of the User that fulfills any of these situations.

    The Customer is responsible for the veracity of the data communicated to CORKBRICK and undertakes to immediately insert into its CORKBRICK Register Account at the Website any changes thereto.

    CORKBRICK declines any responsibility for any delay or impossibility of processing the order, namely at the time of delivery, due to error or insufficiency of the data communicated by the Customer.

    The Website may contain links to other electronic pages or be accessed through other electronic pages. CORKBRICK may not be held responsible for these pages, in particular for the content control, availability, operability or performance.

    CORKBRICK declines all responsibility in case of violation of the legislation of the country where the order is delivered. It is the Customer's responsibility to verify with the local authorities the conditions of importation or use of the Products that he wishes to order.

    To the extent permitted by law, CORKBRICK disclaims any and all liability (direct or indirect) resulting from using the Website.

    IX – ORDERING ONLINE

    To make purchases through the Website you must register as a Customer by completing the form available online. Once you have registered, simply enter all the items you wish to purchase in the virtual shopping basket. You should follow all the steps of the purchase so that it is completed successfully.

    The validation of the purchase order implies that the Customer has taken cognizance and expressly accepts the present Terms and Conditions of Access, Use and Contracting, available for consultation at the Website. The data registered by CORKBRICK constitute evidence of the set of transactions between CORKBRICK and the Costumer. It is the responsibility of CORKBRICK to file the electronic document in which the contract is formalized and to keep it accessible.

    As soon as you complete your purchase, you will receive an automatic email confirming the transaction. You must then reiterate your purchase so as to your order become final. In case the data is not correct you can ask immediately for its change, or even, the cancellation of the purchase made.

    In the purchase of Products marketed at the Website, CORKBRICK admits the following payment methods:

    • Visa
    • MasterCard
    • PayPal

      PRODUCT SHIPMENT

      CORKBRICK only processes an order placed by a Customer upon confirmation of payment, and CORKBRICK can not guarantee the availability of the items until the beginning of the processing. In the check-out the Customer finds the estimated price of shipment.  Shipping prices vary by territory. A time for transport is added to the estimated time for shipment with the confirmation of the order. The time for transport depends on the chosen carrier as well as the destination of the order.

      CORKBRICK only dispatches on weekdays. In this way, neither weekends nor holidays are counted towards estimated delivery of parcels. In any case, the estimated delivery dates are indicative only.

      Any delay in the shipment of articles, compared to the estimated dates presented, does not give the customer the right to any compensation.

      XI – CANCELLATION, EXCHANGE AND REFUND POLICY

      XII – CONSUMER ASSURANCE AND AFTER-SALES ASSISTANCE

      Pursuant to Decree-Law no. 67/2003 of 8 April, which transposes Directive 1999/44/EC of the European Parliament and of the Council of 25 May, as amended by Decree-Law no. 84/2008 of 21 May, all products  sold through the Website are covered by a guarantee of conformity of the goods corresponding to a period of two years.

      Should the purchased product prove to be defective, the Customer must notify CORKBRICK Customer Support, informing the order number and the description of the defect. Costs for returning  items within the warranty period will be borne by CORKBRICK (See Cancellation, Exchange and Refund Policy).

      Upon receipt of the article at the CORKBRICK premises, a technical verification will be carried out and, if there is evidence of any lack of conformity, the article will be replaced and resent to the Customer's address without any additional cost. Alternatively, if the Customer wishes so, the contract will terminate and all costs refunded.

      If the technical verification detects signs of misuse, and / or any problem attributable to any customer’s unsuitable behavior, that may have caused the defect of the item, no replacement takes place.

      XIII – GOVERNING LAW

      All purchases made through the Website are subject to Portuguese and European Union legislation. Any conflict or divergence of interpretation of the Terms and Conditions of Access, Use and Contract shall be submitted to the competent Portuguese Court.

      In the event that the Customer is outside the Portuguese territory, CORKBRICK hereby informs that any judicial proceeding must be referred to the Portuguese Courts.

      XIV – FINAL PROVISIONS

      In the event of a breach of these Terms and Conditions, CORKBRICK reserves the right to take any and all action provided for by law. In addition, CORKBRICK reserves the right to, at its own discretion, terminate the access or use of the Website, with or without notifying the User or the Costumer.

      The Terms and Conditions of use of the Website are regulated according to the laws of Portugal.

      If any rule described herein becomes illegal, null or for any other reason unenforceable, this rule will be eliminated or reduced according to the law, but the validity and enforce ability of the remaining conditions shall not be affected.

      CORKBRICK reserves the right to change these Terms and Conditions without prior notice. The User and the Costumer are bound by the version of the Terms and Conditions in force each time the Website is used, so we recommend that you read it periodically.
